These Terms of Service (“Terms”) govern your access to and use of cbcbackroom.com, including its products, content, checkout features, customer accounts, communications, and related services collectively referred to as the “Services.”
The Services are operated by CBC Backroom, also displayed on the website as cbc store (“CBC Backroom,” “CBC,” “we,” “us,” or “our”).
By accessing the Services, creating an account, submitting an order, or purchasing a product, you agree to these Terms, our Privacy Policy, and our separate Return & Refund Policy.
Please do not use the Services or place an order if you do not agree to these policies.
1. Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction to purchase through the Services.
If you are under the age of majority where you live, you may only use the Services or place an order with the permission and involvement of a parent or legal guardian.
By placing an order, you represent that:

2. Our Store
CBC Backroom operates an independent resale store offering products that may include sneakers, shoes, coats, clothing, accessories, electronics, AirPods, and related merchandise.
Product inventory may be limited. Products may sell out or become unavailable without notice.
Adding an item to your cart does not reserve the item or guarantee its availability.
We may limit the number of products purchased by any person, household, customer account, payment method, billing address, or shipping address.
3. Independent Reseller Disclosure
CBC Backroom is an independent reseller unless a product listing expressly states otherwise.
CBC Backroom is not sponsored by, endorsed by, authorized by, or formally affiliated with the brands, manufacturers, designers, trademark owners, or distributors whose products may appear through the Services.
Brand names, product names, logos, photographs, and trademarks belong to their respective owners and are used for identification and product-description purposes.
4. Product Authenticity
CBC Backroom does not knowingly sell counterfeit merchandise.
Products may be obtained through independent suppliers, individual sellers, distributors, secondary-market sources, retail channels, or other resale channels.
Customers who have a reasonable concern about the authenticity of an item must contact us promptly at cdctybusiness@gmail.com.
We may request:

Photographs or video of the product.

Photographs of labels, serial numbers, tags, or packaging.

A description of the customer’s concern.

Return of the product for inspection.

5. Product Descriptions
We attempt to present product names, photographs, sizes, colors, materials, condition, features, and prices accurately.

Minor manufacturing or packaging variations may occur.

Customers are responsible for reviewing the product listing, selected size, selected color, quantity, condition, price, and shipping information before completing checkout.
Contact us before ordering when a product’s condition, sizing, included accessories, or other details are unclear.
6. Orders
Submitting an order is an offer to purchase the selected products.
An automated order confirmation only confirms that we received your order. It does not guarantee final acceptance, availability, or shipment.
We may accept an order by:

7. Pricing and Taxes
Unless otherwise stated, prices are shown in U.S. dollars.
Prices may change at any time before an order is accepted.
Applicable taxes, shipping fees, discounts, and other charges will be displayed during checkout when available.
We may correct an obvious pricing, inventory, promotional, or typographical error even after an order has been submitted.
If correcting an error materially changes your order, we may contact you for approval or cancel and refund the affected order.
8. Payment
Available payment methods may include payment cards, digital wallets, PayPal, Shop Pay, or other payment options displayed during checkout.
Payments may be processed by Shopify, PayPal, card networks, banks, wallet providers, cryptocurrency-payment providers, or other third-party payment processors.
By submitting payment information, you represent that you are authorized to use the selected payment method.
You authorize CBC Backroom and its payment processors to charge the payment method for:

9. Promotional Codes
CBC Backroom may offer discount codes, free-shipping codes, bulk-order promotions, or other limited promotions.

A return that causes an order to no longer meet the requirements of a bulk or quantity-based promotion may cause the refund to be recalculated based on the products kept by the customer.
10. Shipping
CBC Backroom may advertise a general shipping or processing timeframe. Unless a product listing or checkout disclosure expressly states otherwise, advertised timeframes are estimates and are not guaranteed delivery dates.
Order processing time and carrier transit time are separate.
Delivery may be affected by:

High order volume.

Address errors.

Fraud or payment reviews.

Supplier or inventory delays.

Service interruptions.

Events outside our reasonable control.
When we cannot ship an order within the timeframe provided, we may contact the customer with a revised estimate, permit cancellation, or cancel and refund the affected order as required by applicable law.
11. Shipping Addresses
Customers must provide a complete and accurate delivery address.
Contact us immediately if an address must be corrected. We cannot guarantee that an address can be changed after the order enters processing or shipment.
CBC Backroom is not responsible for delays or delivery problems caused by:

Failure to retrieve a package.

Unauthorized address forwarding.

An address change requested after shipment.
Additional charges caused by an incorrect, incomplete, refused, or undeliverable address may be charged before reshipment or deducted from an eligible refund where permitted by law.
12. Tracking and Delivery
Tracking information may be sent to the email address or telephone number associated with the order.
Customers are responsible for monitoring tracking and promptly reporting delivery problems.
When tracking shows a package as delivered, the customer should first:

Confirm the shipping address.

Check entrances, mailrooms, parcel lockers, and nearby delivery locations.

Ask household members or building staff.

Contact the shipping carrier.

Contact CBC Backroom if the package remains missing.
We may request carrier records, photographs, a written statement, identity verification, or other information needed to investigate a missing-package claim.
13. Returns and Refunds
All returns, exchanges, damaged-product claims, incorrect-item claims, authenticity concerns, canceled orders, and refunds are governed by our separate Return & Refund Policy.
The Return & Refund Policy is incorporated into these Terms by reference.
Customers should review that policy before purchasing.
Nothing in these Terms or the Return & Refund Policy limits any consumer right that cannot legally be waived.
14. Order Cancellations
Cancellation requests must be submitted as soon as possible.
We cannot guarantee that an order can be canceled after it has entered processing, been packaged, been submitted to a supplier or fulfillment provider, or been shipped.
When an order can no longer be canceled, the customer may request a return after delivery if the product qualifies under the Return & Refund Policy.
15. Customer Accounts
The Services may allow customers to create accounts, review orders, store preferences, or check out more quickly.
Customers are responsible for:

By submitting content intended for publication or promotional use, you grant CBC Backroom a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and use that content in connection with operating and promoting the Services.
You represent that your submitted content:

Is not unlawful, threatening, defamatory, fraudulent, or deceptive.

18. Chargebacks and Payment Disputes
Customers should contact us at cdctybusiness@gmail.com before initiating a payment dispute so that we have an opportunity to investigate the issue.
Nothing in these Terms prevents a customer from exercising valid rights through a bank, card issuer, payment processor, or applicable law.
However, knowingly making a false claim, falsely reporting an authorized purchase as unauthorized, or retaining merchandise after obtaining an improper refund may constitute fraud.
We may submit relevant order records, tracking information, account records, customer communications, and other evidence when responding to a payment dispute.
19. Intellectual Property
The Services and their original content—including the CBC Backroom name, website design, graphics, product photographs owned by us, text, logos, and promotional materials—are owned by or licensed to CBC Backroom and protected by applicable law.
You may use the Services only for lawful personal shopping purposes unless we provide written permission for another use.
These Terms do not transfer ownership of CBC Backroom intellectual property or any third-party trademark displayed through the Services.
20. Third-Party Services
The Services may use or link to third-party platforms, including:

CBC Backroom does not control and is not responsible for every third-party platform’s availability, security, content, practices, or performance.
21. Privacy
Our collection, processing, use, and disclosure of personal information are governed by our Privacy Policy.
If these Terms conflict with the Privacy Policy concerning personal information, the Privacy Policy controls for that issue.
22. Service Availability
We may update, suspend, restrict, modify, or discontinue any part of the Services.
We do not guarantee that the Services will always be uninterrupted, secure, accurate, error-free, or available on every device.
We may correct errors involving products, descriptions, prices, discounts, shipping charges, inventory, or availability.
23. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided on an “as available” basis.
Except for express promises made in these Terms, the Return & Refund Policy, an applicable product listing, or rights that cannot legally be excluded, CBC Backroom disclaims implied warranties to the fullest extent permitted by law.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted.
24. Limitation of Liability
To the fullest extent permitted by law, CBC Backroom and its owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Services or a product purchase.
To the fullest extent permitted by law, CBC Backroom’s total liability arising from a particular order will not exceed the amount paid to CBC Backroom for the product giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold CBC Backroom harmless from third-party claims, liabilities, damages, and reasonable expenses resulting from:

Your material violation of these Terms.

Your infringement of another person’s rights.

Fraudulent activity performed through your account.
This provision does not require a customer to indemnify CBC Backroom for CBC Backroom’s own unlawful conduct, negligence, or breach of these Terms.
26. Suspension and Termination
We may suspend or terminate access to the Services when we reasonably believe a customer has:

Abused ordering, promotional, return, or payment-dispute systems.

Engaged in unlawful or threatening conduct.
Termination does not eliminate rights or obligations that arose before termination.
27. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules.
Disputes that cannot be resolved informally may be brought in a court with lawful jurisdiction in Maryland.
This provision does not deprive a customer of any mandatory consumer protections that apply based on the customer’s location.
28. Changes to These Terms
We may update these Terms to reflect changes to the Services, business operations, technology, or legal requirements.
Updated Terms will be posted with a revised “Last Updated” date.
Changes apply prospectively unless otherwise permitted by law.
Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms.
29. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent legally permitted or removed if necessary.
The remaining provisions will continue in effect.
30. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
Any waiver must be express and in writing.
31. Entire Agreement
These Terms, the Privacy Policy, the Return & Refund Policy, applicable product listings, and checkout disclosures form the agreement between the customer and CBC Backroom concerning the Services.
When a product listing or checkout disclosure directly conflicts with these Terms regarding a specific order, the more specific disclosure will control for that order unless prohibited by law.
